Abstract
Consumer is a person who consumes products and use services provided to him by the seller or business. Consumer Protection is the social economic activity done by the government and businesses on daily basis so that the consumers’ interests are protected against the faulty products and unfair practices in trades. The consumer protection has a vast history around the globe and was considered as the prime responsibility of ruler. Even in the modern times, i.e., the formation of welfare states the consumer protection is given due attention because the consumer now a days is the backbone of state’s economy as he is one who is allowing businesses to create revenue and from this revenue the tax is paid to country. Pakistan and India, both are the strong and independent countries and constitution of both countries provides that both countries will be the welfare states. History of consumer protection in these countries can be traced back to their respective religious and cultural histories. This study aims to analyze and compare the consumer protection laws of both countries, identifying and investigating their similarities and differences in various aspects like implementation and enforcement mechanism. The methodology used in the study is the comparative analysis, in which the doctrinal research is conducted using various primary and secondary sources and qualitative data was used from the research to reach conclusion. The conclusion of the study shows that the legal frame works in both counties may same in spirit but contain minor differences and in which Indian laws are slightly better, also the recommendations are provided in which the Pakistan can take lessons from Indian legislations.
