    The phenomenon of shared parenting in pakistan

    This thesis digs into the concept of shared parenting after divorce in Pakistan and sheds light on the discrimination faced among non-custodial parent and custodial parent in child’s custody matter. This research discusses the legal framework available for custody litigation and provides the Islamic principles for deciding child’s custody matters. Despite the available legal framework, the non-custodial parent faces a lot of challenges in getting child’s custody and proper visitation rights. It also explores the societal and judicial practices in regard of shared parenting after divorce, and elaborates the concerns and hardships faced by non-custodial parent for basic rights towards the child as the ongoing custody arrangements focus on sole custody and eliminate the non custodial parent from child’s life by setting out restricted interaction arrangements. Moreover, this research provides a comparison with the UK arrangements of child’s custody. The findings underscore that shared parenting is the most beneficial approach towards the welfare of a child, and its sole purpose is to provide a sound environment to the child in the traumatic situation of parental divorce, and it is the only way out to keep both parents in the loop for child’s interest. This research provides suggestive measures to cope up with the difficulties faced by non-custodial parent and to increase the trend of shared parenting after divorce by setting judicial precedents and societal awareness.
